THE SALE OF A PICTURE HOUSE. JUDGEMENT AGAINST DEFAULTING PURCHASER. In the Lancashire Chancery Court sitting at Manchester yesterday the Collyhurst Palace Company Limited, Collyhurst Street, Rochdale Road, Manchester, applied for judgement in an action brought by them against Percy Hothersall, architect and surveyor, Mosley Street, Manchester to enforce the specific performance - or in the alternative, damages - of a contract for the sale of the land and buildings in Collyhurst Street and the business of a kinematographic picture theatre carried on thereon. [Manchester Guardian 31 May 1923 page 16]

The agreement had been entered into in November 1921, Hothersall undertaking to purchase the property for £15,000. He was required to pay a deposit of £1,500 but this he had not done, informing the cinema company that he was not in a position to complete the purchase. In the meantime the directors had carried out their side of the agreement, and had obtained the sanction of the shareholders to the transfer of their shares. Judgement was given for the plaintiffs.
