DAMAGES CLAIMED FOR BREACH OF CONTRACT - At the Manchester Assizes, last week, Dr. Cox claimed damages for breach of contract against Messrs. Moore and Sons, contractors. In 1888 Dr. Cox determined on building a house at Eccles. Tenders were invited, and the lowest of five sent in was £2,233 and the highest £2,800. Dr. Cox accepted the lowest of these tenders, and the work began. A contract was drawn up, and this, the plaintiff alleged, had been broken by the defendants, the materials not being, as provided, of the best quality. Dr. Cox now sought to recover in money the difference in the value of the house actually built and the house which should have been built. For the defendants, it was submitted that their work was done honestly and well. Defects in the building of the house there undoubtedly were but they were such as the defendants had from the first been prepared to remedy, in accordance with the contract. The judge directed a verdict for the defendants and gave judgment. [Building News 12 December 1890 page 842]
